# TERMS OF SERVICE

## Article 1: Introduction
These Terms of Service (hereinafter “TOS”) define the terms of use of the services provided by Avesta Vision, a micro-enterprise registered under SIRET number 752495762, with its registered office at 6 place Emmanuel Chabrier, 66000 Perpignan, France (hereinafter “the Service Provider”).
## Article 2: Services Offered
Avesta Vision offers the following services:
– AI-assisted video clip creation
– VJ loop video pack creation
– AI-assisted graphic content creation (social media content, advertisements, graphics)
– Spotify and YouTube visualizer creation
– Soundtrack creation
– Video and audio editing
– Scriptwriting and scenario writing
– Advertising and marketing strategy services
– Generative AI consulting
## Article 3: Access to Services
3.1 Services are accessible to both individuals and professionals, with no age restriction.
3.2 The Client agrees to provide accurate information when placing orders or contacting the Service Provider.
## Article 4: Orders and Payment
4.1 Service prices are indicated in euros and are subject to payment.
4.2 Orders are considered final upon receipt of full payment.
4.3 Accepted payment methods will be specified at the time of order.
## Article 5: Intellectual Property
5.1 All content created by Avesta Vision remains its property until full payment for services is received.
5.2 After full payment, the Client receives a usage license according to the terms specifically agreed upon for each project.
5.3 The use of artificial intelligence in the creative process is explicitly mentioned and accepted by the Client.
## Article 6: Personal Data Protection
6.1 The Service Provider only collects client email addresses during purchases.
6.2 This data is used exclusively for:
– Order processing
– Communication regarding ordered services
– Invoice sending
6.3 In accordance with GDPR, clients have the right to access, rectify, and delete their data.
## Article 7: Delivery and Deadlines
7.1 Delivery times are provided as estimates at the time of order.
7.2 The Service Provider commits to respecting agreed deadlines or informing the Client in case of delay.
## Article 8: Modifications and Revisions
8.1 Each project includes a defined number of revisions, specified in the quote.
8.2 Any additional modifications will be subject to additional billing.
## Article 9: Liability
9.1 The Service Provider commits to executing its obligations with care and diligence.
9.2 The Client is responsible for the content and elements provided for service execution.
9.3 The Service Provider cannot be held responsible for the Client’s use of delivered creations.
## Article 10: Termination
10.1 The Service Provider reserves the right to terminate any contract in case of:
– Non-payment
– Non-compliance with these TOS
– Requests contrary to applicable law
10.2 In case of termination, amounts already paid will remain with the Service Provider.
## Article 11: Force Majeure
The Service Provider cannot be held responsible for non-performance due to force majeure as defined by French jurisprudence.
## Article 12: Applicable Law and Jurisdiction
12.1 These TOS are governed by French law.
12.2 In case of dispute, parties will endeavor to find an amicable solution.
12.3 Failing that, the courts of Perpignan will have exclusive jurisdiction.
